Item 7.01 Regulation FD Disclosure. On March 9, 2026, Archer Aviation Inc. (the “Company”) filed a counterclaim and answer in its ongoing federal court litigation with Joby Aero, Inc. and Joby Aviation, Inc. (together, “Joby”) before the United States District Court for the Northern District of California. In its counterclaim, the Company asserts various claims against Joby, including for unfair competition and false advertising. The Company is seeking damages, declaratory relief, and certain other remedies. On the same date, the Company filed a complaint with the U.S. International Trade Commission (“ITC”) requesting the ITC prevent Joby from importing certain products manufactured by, or on behalf of, Joby relating to its electric vertical takeoff and landing (“eVTOL”) aircraft based on the Company’s claims that such products infringe certain of the Company’s patents. The Company’s asserted U.S. patents include patent numbers: 11,945,594; 12,162,614; 8,469,306; 12,103,404; and 12,473,087 that relate to eVTOL aircraft, power systems for eVTOL aircraft, and components thereof.
